DermApp Sàrl (hereinafter: "DermApp") acknowledges that the collection of Personal Data and Sensitive Data involves a great deal of trust on your part.

We take this trust very seriously and make it a priority to ensure the greatest confidentiality and security regarding your Personal Data and Sensitive Data.

The terms not defined in our privacy policy (hereinafter: "Privacy Policy") are specified in the terms and conditions of the Site.

By using the Site, you agree to the practices described below:

1. Personal Data and Sensitive Data

  • Personal Data refers to the data defined in Article 3(a) of the Federal Data Protection Act (LPD; RS 235.1) and the Federal Ordinance on Data Protection (OPD; RS 235.11), meaning any information related to an identified or identifiable person.
  • Sensitive Data refers to the data defined in Article 3(c) of the LPD, namely personal data concerning health, intimate life, or racial affiliation, which are contained in the Photos, the Questionnaire, the Evaluation Request, and/or the Diagnosis, and/or any message exchanged through the Site with a Dermatologist.

2. Data Controller

The data controller for your Personal Data (i.e., the legal entity responsible for the data file's content) is DermApp Sàrl, Route de la Corniche 1, 1066 Epalinges, Switzerland, info@dermapp.ch.

The data controller for your Sensitive Data will be the Dermatologist who handles your Evaluation Request.

3. Purpose of the Privacy Policy

DermApp provides this Privacy Policy to clarify the type of personal data collected through the Site and its procedures for collecting, processing, storing, transferring, using, and disclosing your Personal Data.

This Policy applies to any use or visit of the Site, regardless of the method or means used.

It details the conditions under which your Personal and Sensitive Data are collected when you use the Site.

4. Consent

By using or visiting the Site, whether as a User, Dermatologist, or Visitor (hereinafter: "You"), you agree that DermApp collects and processes your Personal Data and that Dermatologists collect your Sensitive Data in accordance with this Privacy Policy.

By accessing, Browse, or using the Site, you acknowledge that you have read and understood this Privacy Policy and agree to be bound by it and to comply with all applicable laws and regulations.

5. Changes to the Privacy Policy

DermApp reserves the right to make any changes to its Privacy Policy.

If this happens, you will be notified by email or notification, and your consent for these changes will be required.

If you disagree with these changes, you may close your Account.

In such cases, we assure the portability of your Personal Data.

6. Sensitive Data Collected Through the Site

By submitting Photos, the Questionnaire, and/or an Evaluation Request through the Site, you are submitting Sensitive Data about yourself to the Dermatologist.

You expressly agree that DermApp processes such Sensitive Data through the Site and that the Dermatologist who provides you with a Diagnosis stores them on their server and/or on their Account with DermApp.

7. Personal Data That May Be Collected

Personal Data provided by the User and/or Dermatologist

When you register on the Site, create or modify your Account, and/or use the Site, we collect, process, and store your Personal Data.

We may also collect Personal Data that you provide while Browse the Site.

When you register as a User or Dermatologist or log into the Site, or interact with DermApp in any other way (including by email), you may be asked to provide certain information, including (but not limited to):

  • User Registration Data: Some features of the Site are reserved for Users or Dermatologists who have created an Account.

These details are required to identify you and allow (i) the creation, modification, execution, and termination of a contractual relationship, (ii) communication with you in connection with the Site and its features, and (iii) to avoid any violation of the Terms of Use.

8. Uses of Your Personal Data

DermApp uses your Personal Data primarily to improve the Site and provide you with Services through a Dermatologist.

You consent to DermApp using your Personal Data (excluding Sensitive Data) for the following purposes:

Site Operation

Your Personal Data will be used by DermApp to offer all the Site's functionalities to Users and Dermatologists, to ensure the proper execution of all the Site's features, to interact with Users and Dermatologists, and to respond to questions and feedback from Users and Dermatologists.

DermApp will also use your Personal Data for the following reasons:

  • Processing your Evaluation Requests by a Dermatologist;
  • Performing the Diagnosis through a Dermatologist;
  • Billing the Diagnosis;
  • Better responding to your requests;
  • Continuously improving the Site and/or our Services;
  • Conducting studies and gathering statistical data on User and/or Dermatologist habits;
  • Creating internal reports or providing reports to external partners;
  • Managing your Account;
  • Communicating with you;
  • Responding to your questions and emails;
  • Sending you the DermApp newsletter as long as you are subscribed;
  • Preventing potential illegal activities;
  • Ensuring the security of the Site;
  • Improving the Site's functionality;
  • Enforcing the Site's Terms of Use;
  • Accessing third-party services if you connect to your account via third-party services.

Marketing

DermApp may use your Personal Data to send you information about the Services offered through the Site, customized emails, newsletters, or promotional offers, and to develop a direct relationship with each User.

You may also receive messages from DermApp, as well as targeted advertising.

DermApp can use your Personal Data collected through or via the Site to personalize the promotional offers you see, including based on your activity.

Your Personal Data may also be used to develop partnerships with third parties and create new services, features, or activities for the Site, especially based on your profile, how you use the Site, and the information you provided during registration.

However, DermApp is committed to not selling your Personal Data. A transfer of DermApp's assets is expressly reserved.

Customization

DermApp may use data and information to analyze your preferences and habits, personalize your use of the Site, and improve the Site and all its features.

This also allows DermApp to provide each User with content on the Site that is better suited to their interests.

System Reports and Maintenance

For operational and maintenance purposes, DermApp or a third party may collect files that record your activity on the Site (system reports) or use other Personal Data (such as IP addresses or IMEI numbers) for this purpose.

9. Use and Storage of Your Sensitive Data by Dermatologists

Your Sensitive Data will be processed exclusively by the Dermatologists registered on the Site, who will be responsible for the processing.

DermApp acts only as a facilitator for transmitting this Sensitive Data to the Dermatologists.

You agree that the Dermatologist is exclusively responsible for the processing of your Sensitive Data, with DermApp being completely excluded from this responsibility.

Sensitive Data will only be used by the Dermatologist for the purpose of following up on your Evaluation Request and making the Diagnosis.

You consent to the Dermatologist transferring your Sensitive Data to another registered Dermatologist for the purpose of establishing the Diagnosis and/or if their schedule does not allow them to make the Diagnosis on time.

You expressly agree that your data be communicated to Dermatologists and stored on the server and/or the Account of the Dermatologist who carried out the Diagnosis.

You also consent that the Dermatologist handling your Evaluation Request may submit your Sensitive Data to another colleague if they are unable to establish a Diagnosis.

DermApp declines any responsibility in case of security breaches or cyber-attacks related to Sensitive Data processed and/or hosted by the Dermatologists.

10. Cookies, Web Beacons, and Similar Technologies

A cookie is a piece of information that is automatically placed on the hard drive of your computer or mobile device when you access certain websites or apps (hereinafter: a "Cookie").

The Cookie uniquely identifies your browser to the server. Cookies allow DermApp to store information on the server (e.g., language preferences, technical information, access paths or clicks, etc.) that helps make your experience on the Site better and analyze Site traffic and performance.

Most web browsers are set to accept Cookies, although you can reset your browser to refuse all Cookies or to indicate when a Cookie is sent.

Please note that certain parts of the Site may not function properly if you refuse Cookies.

DermApp uses Cookies, Web Beacons on the Site (also known as "action tags" or "invisible GIFs") and other tracking technologies to facilitate your access to the Site and analyze Site traffic and usage, as well as to identify malfunctions.

This also allows DermApp to improve your experience with the Site and improve its content and design.

DermApp may work with other companies that place Cookies, Web Beacons, or other tracking technologies on the Site.

These companies assist DermApp in managing the Site. The use of these technologies by such third parties is subject to their own conditions, privacy rules, and terms of use, which are not covered by this Policy, and DermApp is not responsible for them.

11. Google Analytics

The Site may use Google Analytics, a web analytics service provided by Google Inc. ("Google").

Google Analytics uses Cookies, which are text files placed on your computer to help analyze how Users use the Site.

The data generated by the Cookies regarding your use of the Site (including your IP address) will be transmitted to and stored by Google on servers located in the United States.

Google will use this information to evaluate your use of the Site, compile reports on site activities for its publisher, and provide other services related to the Site's activity and internet usage.

Google may share this information with third parties if required by law or when third parties process this data on Google's behalf, including the publisher of this site.

Google will not cross-reference your IP address with other data held by Google.
